Dynamic purchasing systems: the public contracts you can still join

The most useful distinction in UK public procurement is not between open and restricted procedures. It is between arrangements you can join whenever you like, and arrangements that shut the moment they are awarded.

Frameworks shut. Dynamic purchasing systems do not. For a supplier without a public sector track record, that single difference determines where to spend your effort.

How a DPS works

A dynamic purchasing system is an electronic list of pre-qualified suppliers that stays open for its whole life, often five to ten years. Any supplier meeting the published selection criteria can apply at any point and must be admitted if they qualify. There is no cap on numbers.

When the buyer needs something, they run a competition among all suppliers on the relevant DPS category. If you joined last week, you are in that competition alongside suppliers who joined four years ago.

Under the Procurement Act 2023, DPSs are being succeeded by dynamic markets, which work on the same open-entry principle with some procedural differences. Existing DPS arrangements continue until they expire, so both terms are in circulation and you will see each used.

DPS versus framework

• Entry — DPS: any time. Framework: only during the original procurement.
• Supplier numbers — DPS: unlimited. Framework: fixed at appointment, often 5–20 per lot.
• Competition — DPS: every call-off is competed. Framework: may be direct award or mini-competition.
• Selection — DPS: pass/fail against published criteria. Framework: scored and ranked, with only the top scorers appointed.
• Term — DPS: often 5–10 years. Framework: usually 4.

The trade-off is real: a DPS gets you in the room easily but guarantees competition on every job. A framework is hard to join and can produce direct awards. Neither is better in the abstract — but only one is available to you today.

Where DPSs are used most

• Adult social care and supported living — councils run large DPSs for care packages, domiciliary care and residential placements. Among the most accessible public sector markets for small providers.
• Children's services — foster care, residential placements, education support.
• Home-to-school and social care transport — councils admit new operators continuously, then compete individual routes.
• Construction and maintenance — some authorities run DPSs for repairs, minor works and specialist trades.
• Temporary staffing and interim professionals — widespread across councils and the NHS.
• Consultancy and professional services — increasingly common for lower-value advisory work.

Applying

Selection is pass/fail, not scored, which makes it a compliance exercise rather than a persuasion one. You will typically need:

• Company and financial information, often two or three years of accounts
• Insurance certificates at the specified levels
• Relevant accreditations for the category
• Policies — health and safety, equality, environmental, safeguarding, data protection
• References or evidence of comparable delivery

Get this pack assembled once and keep it current. The same documents satisfy most DPS applications, and the difference between applying to one DPS and applying to eight is then largely administrative.

Getting work once you are on

Being admitted is necessary and not sufficient. The suppliers who win DPS call-offs tend to do three things:

1. Respond fast. DPS competitions are often short — five to ten working days. Suppliers who monitor the portal daily win disproportionately, simply because others miss the window.
2. Bid selectively and well. Because entry is easy, competition is wide. A considered response to the right call-off beats scattergun submissions.
3. Cover a defined patch credibly. Buyers reward reliable coverage of a geography or specialism over broad claims. In transport, that means routes you can genuinely service; in care, a locality you can actually staff.

Finding them

New DPS and dynamic market notices are published like any other contract notice, and they appear continuously rather than in the four-year cycles frameworks follow. Because they stay open, a DPS advertised eighteen months ago is still joinable today — so it is worth searching historic notices as well as watching new ones.
